Judge Foutz graduated from college at Brigham Young University in 1971. He then went on to law school at Southwestern University School of law where he graduated in 1975. He worked for ten months as an Assistant District Attorney. In 1977 he opened his own private practice. He operated his law firm for 20 years. In 1996 he was appointed District Judge.

Judge Foutz's hobbies include playing racquet ball and old cars.
